Terms of Use
Explorestraya — Melbourne
Last updated: 28 August 2026
Draft. These terms were written by the team, not by a lawyer. Have them
reviewed before launch. The clauses most worth a professional eye are the
photo licence (§5), the liability limits (§9), and whether the Australian
Consumer Law wording in §10 is right for your structure.
1. What this is
Explorestraya is a game about walking around Melbourne. You go to a place,
prove you are there, and earn points for it. That is the whole thing.
By using the app you agree to these terms. If you do not, please do not use it.
2. Who can use it
You must be at least 13. If you are between 13 and 15, your account works
normally but you will not appear on leaderboards or other surfaces that show
you to strangers.
We ask for your birth year when you create an account. We use it only to apply
the rules in this section.
3. Your account
One account per person. Keep your password to yourself. Tell us if you think
someone else has got into your account.
You can delete your account at any time from Settings → Your account. We
give you 30 days to change your mind, then everything goes. See the Privacy
Policy for exactly what is deleted and what is not.
4. Walking safely — read this one
You are responsible for your own safety. The app shows you places; it does
not check whether it is safe to go to one right now.
- Watch the road, not the phone.
- Do not enter private property, closed sites, or anywhere fenced off.
- Do not go anywhere you would not go without the app.
- Coastal and bushland places change with weather and tide. Check conditions.
- Some places are unsafe at night, and some are unsafe alone. Use judgement.
No badge, streak or leaderboard position is worth getting hurt over. If a place
is dangerous, report it in the app and we will look at it.
5. Your photos
You keep ownership of every photo you take. Full stop.
To run the app we need permission to use them in specific ways. By uploading a
check-in photo you give us a non-exclusive, worldwide, royalty-free licence
to store it, process it, and show it:
- to you, in your own passport and history;
- to our moderators, to check it is a genuine photo of that place;
- in aggregate anti-cheat processing — we compute a perceptual fingerprint
so the same photo cannot be reused for two check-ins.
**We do not publish your photos to other users, and we do not use them in
advertising.** If that ever changes we will ask you first, per photo, and you
will be able to say no and keep using the app.
The licence ends when you delete the photo or your account, except for
fingerprints already computed — those are not images and cannot be turned back
into one.
Do not upload photos of other people without their agreement, photos you did
not take, or anything unlawful.
6. Points, badges and streaks
XP, badges, collections and streak counts have no monetary value. They
cannot be bought, sold, transferred or exchanged for anything.
We may adjust them when something has gone wrong — a bug, a rejected photo, or
cheating. Adjustments are made by adding a correcting entry, never by quietly
editing history, and you can see every entry in your data export.
7. Playing fairly
Do not fake your location, reuse photos, use software to automate check-ins, or
create accounts to farm referrals.
If we think you have, we may hold XP for review, remove it, or suspend the
account. You can appeal any decision about a photo from inside the app, and a
person will read it.
8. Things we get wrong
Place information comes from open government and council data, edited by hand.
It will sometimes be wrong: a café will have closed, a gate will be locked, a
pin will be a few metres out. Report it and we will fix it.
The app needs a network and GPS to work. Neither is ours, and neither is
reliable everywhere.
9. Our responsibility
We provide the app "as is". To the extent the law allows, we are not liable for
indirect or consequential loss arising from your use of it.
Nothing in these terms limits liability that cannot lawfully be limited —
including for death or personal injury caused by negligence, or fraud.
10. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the
Australian Consumer Law. Nothing in these terms excludes, restricts or modifies
those guarantees.
11. Changes
We may change these terms. If a change matters, we will tell you in the app
before it takes effect. Continuing to use the app after that means you accept
the new version.
